Coaching Terms and Conditions - WBH

1. Parties and Purpose This Agreement is between Well Being Holistic (WBH), ABN 26 085 221 101, with its registered office in New South Wales, Australia, and you, the Client, member individual, who accepts this Agreement by reading the document and ticking the acknowledgment box at the end. By doing so, you agree to engage WBH for coaching and health advocacy services as outlined below. 2. Services Provided Description of Services WBH offers life coaching, group educational sessions, and health advocacy services to support individuals in achieving personal growth and wellness goals. The base model of service delivery has clients become students as part of an online community forum – see Online Forum Terms and Conditions
No Medical Advice or Treatment
WBH services are exclusively for educational and coaching purposes.
These services are not a substitute for medical advice, diagnosis, or treatment. Any discussions, advice, or guidance offered are intended to enhance self-awareness and facilitate lifestyle changes.
"Well Being Holistic does not provide medical advice, diagnoses, or treatment. Although the founder is a registered non-practicing medical doctor, these services are not a substitute for professional medical consultation. Clients should seek licensed healthcare providers for medical diagnosis, treatment, or prescriptions."
Health Advocacy and Practitioner Liaison
WBH may liaise with the Client’s health practitioner team upon specific written request by the Client to share insights from coaching sessions, aiding in the Client’s health management. The Client consents to this communication in advance and acknowledges that any fees from third-party providers will be forwarded to them for payment.
In the potential scenario described in clause 3 Health and Wellness Responsibility, the Client consents to WBH contacting their next of kin and health practitioner team to ensure continuity of care if they require assurance of medical assessment. Non-consensual interaction may result in termination of services on behalf of WBH. WBH does not provide medical treatment but may act appropriately in emergencies based on the clinical training of its founders.
3. Client Expectations and Responsibilities
Commitment to Personal Growth
Clients are expected to actively engage in coaching sessions and take personal and sole responsibility for implementing the strategies and insights discussed.
Health and Wellness Responsibility Clients acknowledge their sole responsibility for managing their health and well-being. Clients must seek professional medical guidance when needed, especially if WBH recommends doing so during any interaction.
If a client disregards advice to seek medical attention, WBH reserves the right to notify the next of kin using the contact details provided during registration.
WBH also reserves the right to terminate any further coaching agreement should the client continue to disregard the recommendation to seek external medical assistance, in which case the privacy policy provisions for indemnity apply.
"Coaching or guidance from WBH is not a substitute for medical advice. Clients bear full responsibility for their health decisions and actions following coaching sessions." 4. Payment and Pricing Pricing Structure
All pricing details are outlined below. Pricing is subject to change without prior notice.
Foundational Course - “How to Train Your DR-agonist” This 6-part video course is designed for patients, doctors, and other health professionals (as we all have our own doctors, inside and out). As a $45 investment in your wellness, it is strongly recommended and needs viewing by members as a prerequisite to access one-on-one calls with Jen Draper or any of the other Well Being Holistic teachers, or to access premium or platinum membership, including the “book-a-chat-see-if-we-gel” session.
During this often-initial session, $45 deposit is collected and refunded only if either party decides against continuing the relationship during the call.
Refund Policy: No refunds are offered for the foundational course except for the scenario outlined above.
Individuals or organizations already known to Jen Draper within the past five years (as a patient or colleague of Dr. Jenny Draper in her role as a practicing registered medical doctor) are encouraged to book a “book-a-chat-see-if-we-gel” session to determine the appropriate membership level for their unique health journey. Upon doing so, they will gain access to the Foundational Course, that would only be revoked in accordance with this cancellation policy. Premium Membership
Premium members gain access to two live Zoom calls per week, where they can receive guidance, advice, and participate in community learning. This membership is tailored for individuals deeply committed to understanding health system navigation and advocacy while supporting others on similar journeys.
Participants may choose to remain anonymous by using an alias within the community. Calls are recorded and may be used to develop future educational resources, with privacy levels dictated by the amount of personal information shared by participants during sessions.
The premium community also includes interactive chatbots programmed with AI to address common scenarios in health advocacy. Additionally, private conversations with a virtual version of Jen Draper and other teachers are available, leveraging transcripts of Well Being Holistic philosophies for tailored guidance.
Membership Fee: $300 per month (variable pricing available for groups and organizations). Cancellation: Members may cancel and rejoin at any time.

Platinum Membership Platinum members receive up to 13 calls each month, including two group calls per week and three additional 90-minute one-on-one calls during the month with Well Being Holistic teachers. This membership is ideal for individuals requiring intensive support to address significant challenges within the health system. Membership Fee: $3000 per month (variable pricing available for groups and organizations). Cancellation: Members may cancel and rejoin at any time.

General Terms

All WBH services, courses, and community interactions are for educational and self-development purposes only. WBH does not provide medical advice, treatment, or diagnoses. Clients participate voluntarily, acknowledging that the purpose of the WBH community is to share insights and strategies for navigating the health system more effectively.
Payment Methods and Timing
Payments are due at the time of purchase and are inclusive of and limited to credit or debit card payments via Paypal, Stripe or manually via direct bank transfers with emailed proof of payment.

Refund and Cancellation Policy Refund Policy: No pro rata refunds are available, except in cases of severe illness or death that prevent completion of the calendar month for platinum level only and in initial cases during the “book-a-call-see-if-we-gel".
No refunds are offered for membership fees. However, members may rejoin at any time to regain access.
"Sessions cancelled within 24 hours of the scheduled time may incur a cancellation fee. Refunds are not available for completed sessions." 5. Confidentiality and Privacy Client Privacy Client confidentiality is a priority. For detailed information, refer to the WBH Privacy Policy.
Limitations to Confidentiality
Confidentiality is subject to legal limitations in specific circumstances, including when WBH is lawfully required to disclose information. See Clause 3: Health and Wellness Responsibility for notable exceptions. 6. Limitation of Liability Scope of Liability For valuable consideration, the Client hereby expressly agrees and covenants without benefit of discussion, and without division, waiving all rights of defence, to indemnify and hold harmless Well Being Holistic, including its agents, employees, officers, directors, or other clients, against any and all claims, legal actions, orders, warrants, judgements, demands, liabilities, losses, depositions, summonses, lawsuits, costs, fines, liens, levies, penalties, interests, and expenses, or damages, whatsoever, both absolute and contingent, as are due and as might become due, now existing and as might hereafter arise, and as might be suffered/incurred by, as well as imposed on, the Client for any reason, purpose and cause whatsoever.
The Client acknowledges that Well Being Holistic shall not, under any circumstances, be considered an accommodation party or surety for the Client. "Well Being Holistic is not responsible for any results or perceived lack of results. All information provided is for personal development purposes and does not constitute professional advice in medical, psychological, or regulated fields."
No Guarantee of Results Coaching results vary by individual, and WBH does not guarantee specific outcomes. 7. Restrictions on Using Services Eligibility Clients must meet all eligibility requirements, including age and location, to access WBH services. Appropriate Use of Services
WBH services are exclusively for personal growth and wellness education. Misuse of services for purposes outside this scope is prohibited. 8. Community Access Access to the WBH community is fundamental to accessing the WBH service model. The Free Online Forum Terms and Conditions explains how this works. 9. Changes to Terms and Conditions WBH reserves the right to modify these Terms and Conditions at any time. Continued use of WBH services after changes indicates acceptance of the updated terms. 10. Governing Law These Terms and Conditions are governed by natural common law. Any disputes will be resolved through the dispute resolution process described in the Free Online Forum Terms and Conditions. 11. Digital Acknowledgment By completing online registration, the Client agrees that this action of sighting or clicking is equivalent to a physical signature and carries the same responsibilities and liabilities as a handwritten autograph. ☐ I have read and agreed to these terms and conditions and associated linked documentation.
